These Terms of Service (“Terms”) govern your use of the Tracking.me services, including our website and mobile applications (the “Services”). If you do not agree to any of these terms, please do not use our services or make any purchase. Using our services or making any purchase through this website means you assent to these terms and conditions. We reserve to make changes to these terms at any time without prior notice. You agree to check these terms and conditions periodically for changes. Your purchase through this website following the posting of changes to these terms and conditions will mean that you accept those changes.
You also acknowledge and agree that, unless expressly provided otherwise in these Terms or a separate agreement between you and Tracking.me, Tracking.me does not form any employment or agency relationship with you and does not hold title to any goods that are delivered to you by a Personal Shopper.
CAPACITY TO ACT
By making a purchase through the website, you warrant that you are above 18 years of age, you have the capacity to act in accordance by law and you are not legally disqualified to enter into agreement as provided by law.
PURCHASE OF PRODUCTS
Your compliance: You agree to comply with any and all the guidelines, notices, operating rules and policies and instructions pertaining to the purchase of Products through this website, as well as any amendments to the aforementioned, issued by Us (whether as part of use of this website or in relation to the purchase of Products, on behalf of Seller), from time to time. We reserves the right to revise these guidelines, notices, operating rules and policies and instructions at any time and you are deemed to be aware of and bound by any changes to the foregoing upon their publication on the Platform.
Product description: While We endeavors to provide an accurate description of the Products, we do not promise that such description is accurate, current or free from error.
Placing your Order: You may place an Order by completing your order (through add to cart) and by clicking out the checkout items. We will not accept Orders placed in any other manner. You shall be responsible for ensuring the accuracy of the Order. You will receive a confirmation email with your order details and delivery date.
Product Warranty: Due to the nature of the product, our warranties are limited. Fresh Produce and Frozen Produce only accept 48 hours money back guarantee if there is quality issue related with decay or damaged. Non-perishable products can be returned within 7 days from the receipt thereof and must be return to our store with original condition. In all instances, we only accept returns for quality related issues. We do not accept returns for change of mind.
Customer’s acknowledgement: You acknowledge and warrant that you have not relied on any term, condition, warranty, undertaking, inducement or representation made by or on behalf of Us which has not been stated expressly in these terms and conditions or upon any descriptions or illustrations or specifications provided in the website including any catalogues or publicity material.
SHIPPING AND DELIVERY
We will arrange for the products to be delivered to the address for delivery indicated in your order. We will use reasonable endeavors to deliver products on or before the date for delivery set out in our order confirmation .
DELIVERY FEE
Delivery fee subject to store category, it differ store to store , we display delivery fee on checkout screen before placing order.
ORDER ACCEPTANCE POLICY
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.
PRICES:
All prices of the products, deliver and other charges are shown in United Arab Emirates Dirham (AED). Prices of products and services are current at time of display but may subject to change without prior notice.
PAYMENT
Payment by Debit Card: All types of debit card are accepted for payment for all Purchase. When paying with a debit card please be sure to state the correct card number, the issue number, the start and expiry date, as well as the correct billing address.
Payment by Credit Card: MasterCard, Visa, American Express and Diners Club cards are all accepted (mention if transaction charge is applicable). When paying with a credit card, please make sure that we have not only the correct card number, but also the correct billing address and the expiry date and the security code on the reverse of your card. This is especially important if you are sending your booking by fax or email.
Cash on Deliery or POS at Doorstep. At the time of delivery, you will have to hand over the cash to the delivery person first, only then you will be handed over the purchased product. The same is applies on POS at doorstep.
THIRD-PARTY PRODUCTS AND CONTENT
You agree that Tracking.me does not assume responsibility for any products, content, services, websites, advertisements, offers, or information that is provided by third parties and made available through our Services. If you purchase, use or access any such products, content, services, advertisements, offers, or information through the Services, you agree that you do so at your own risk and that Tracking.me will have no liability based on such purchase, use or access.
DISPUTES & ARBITRATION
If you have a dispute with Tracking.me, you agree to contact us first and attempt to work it out amicably.
For residents of the United Arab Emirates, you agree to the following mandatory arbitration provisions:
Mandatory Arbitration: If we’re unable to work out a solution amicably, both you and Tracking.me agree to final and binding arbitration as the sole method of resolving any disputes, claims, or causes of actions arising out of your use of the Services or these Terms to court in United Arab Emirates.
CONTROLLING LAW
These terms and conditions will be governed by the laws of the United Arab Emirates, without respect to its conflicts of laws principles. Any claims arising out of or relating to these Terms and conditions shall be brought exclusively before Tracking.me consent to the personal jurisdiction of those courts.
STATUTE OF LIMITATIONS
Regardless of any statute or laws to the contrary, you must file any claim or cause of action arising out or related to your purchase within (1) one year after such claim or cause of action arose or be forever barred. This section shall survive termination of this AGREEMENT.
CHANGES TO THE TERMS
We may make changes to these Terms from time to time. When we do so, we will post the most current version of the Terms on our website. By continuing to use or access the Services after the revised Terms come into effect, you agree to be bound by the revised Terms. At our discretion as to whether a revision to the Terms is material, we may notify you about a revision of the Terms in some way (for example, by email or a posting on our website).
ENTIRE AGREEMENT
These terms and conditions constitute the entire agreement between YOU and Tracking.me in relation to your purchase or the use in any of our services. No additional provisions are expressed nor implied. This Terms and Conditions supersedes any all previous oral and/or written, express and/or implied agreements. By using our services or making any purchase, YOU HAVE READ AND FULLY UNDERSTOOD THIS AGREEMENT and ACCEPTS ALL TERMS, CONDITIONS, COVENTANTS AND RESTRICTIONS, and WITHOUT EXCEPTION.
